Contracting party and scope

Your contracting party is Sporthaus Andreas Egger KG, Marktstraße 78, 5661 Rauris, Austria (“Sport Egger”). These rental terms apply to all rental contracts for sports equipment, whether you reserve online, by phone or in the shop.

The person who books concludes the contract for everyone listed in the booking and is responsible for the accuracy of their details.

Reservation and contract

Online, you choose the rental period, guests, equipment category and – for skis – the boot option. The rental contract is concluded once the online payment has succeeded and you have received the booking confirmation by email. Without a successful payment, no contract is formed and no equipment is reserved.

You reserve a category (for example Comfort, Sport or Performance), not a specific model. Photos show example models; depending on size, ability and availability you receive an equivalent model from that category.

Prices and payment

The prices shown when booking apply, in euros including VAT. The rental price depends on category, boot option and number of rental days; the pickup day and the return day each count as a full rental day.

The full amount is payable when booking online. Payment is processed by our payment provider Stripe.

Selected ski helmets and optional breakage & theft protection are included in the online amount. The online discount applies to helmets but not protection. Services agreed in the shop, such as extensions, are paid additionally in the shop.

Pickup, ID and fitting

Pickup takes place on the first rental day during our opening hours in the shop. Please bring your booking confirmation (printed or on your phone) and an official photo ID of the person collecting. We only check the ID and do not keep it.

Everyone whose equipment needs fitting should be present at pickup. We set ski bindings based on the height, weight, age, ability and boot sole length you provide. Incorrect or incomplete details may lead to an incorrect setting.

Please check the equipment at handover and report visible defects immediately. If you notice a defect later, let us know straight away; where possible we exchange the equipment.

Return, extension and late return

Return the equipment to the shop by closing time on the last booked rental day. Please return it complete and roughly cleaned.

If you would like to extend, please contact us before the rental period ends. Extensions are possible subject to availability and are charged according to the current price list.

If equipment is returned late without prior agreement, we charge the daily price of the relevant category from the current price list for each additional day or part of a day.

You can return equipment early at any time. Unused days are not refunded, except in case of illness or injury (see below).

Cancellation, changes and no-shows

You can cancel free of charge until 24 hours before the start of the pickup day, i.e. until midnight at the end of the second day before pickup. Example: for pickup on Saturday, cancellation is free until Thursday, midnight.

Please cancel by email to info@sportegger.at or by phone on +43 660 8500011; the time we receive your cancellation counts. We refund the amount paid in full to the original payment method.

For later cancellations, and if equipment is not collected without prior cancellation (no-show), the rental price is not refunded. Collecting after the first rental day does not extend the rental period.

Changes to dates, guests or equipment are possible until the free cancellation period ends, subject to availability; price differences are settled. After that, changes are only possible by agreement.

Illness, injury, weather and lift operation

If illness or injury prevents you from using the equipment during the rental period, please return it promptly. On presentation of a medical certificate, we refund the unused full rental days from the day after return or, if you prefer, issue a credit.

Bad weather, lack of snow, avalanche danger and restricted or suspended lift operation do not entitle you to a refund, as the equipment remains available to you.

Taking care of the equipment

Please treat the rental equipment with care and use it as intended:

• Equipment may only be used by the person it was set up for. Passing it on to others is not permitted.
• Do not change the binding setting yourself. If you need a different setting, please come to the shop.
• Secure the equipment against theft during breaks and overnight, for example in a ski depot, with skis stored separately or with a lock.
• Report defects and damage immediately. Repairs may only be carried out by Sport Egger.

Damage, theft and loss

Normal wear from proper use is included in the rental price.

For damage beyond that, and for theft and loss, you are liable under the statutory provisions if you are at fault. We charge the actual repair costs, but no more than the current value of the equipment; for theft or loss, the current value.

Please report any theft to the police immediately and bring us the police report confirmation.

Optional breakage & theft protection for ski sets: you can add protection per person when booking or when renting in the shop. It costs 15% of the rental price of the respective set and is charged accordingly if you extend your rental.

With this protection, we cover the costs of breakage and damage to the rented skis and, where applicable, hire boots, with no excess. In case of theft you pay an excess of no more than €100 per incident, provided the equipment was locked or stored in a ski depot and you give us confirmation of the police report.

It does not cover loss without theft, theft not reported to the police or of unsecured equipment (for example left unattended or taken from an unlocked vehicle), damage caused intentionally or through gross negligence, or damage resulting from use contrary to these terms, such as passing the equipment on to others. The protection is not insurance but a waiver by Sport Egger of claiming these costs.

Ski helmets

Add a ski helmet for each person who needs one. Its price is included in the online total with the 10% online discount. We check the fit at collection.

E-bikes

Our e-bikes are pedelecs with pedal assistance up to 25 km/h. Road traffic regulations and the rules of the respective paths apply; ride only on roads and paths open to bikes.

We recommend a helmet for everyone; for children under 12 it is required by law. Never leave the e-bike unlocked, and use the battery and charger only as explained at handover.

Children and young guests

Bookings for children and young guests are made by an adult. Enter each child’s age on the pickup day when booking; it determines category and price. Supervision of the equipment’s use lies with the parents or guardians or the accompanying adult.

Sport Egger’s liability

We hand over the equipment serviced and in technically sound condition and set ski bindings professionally. We are liable under the statutory provisions. We are not liable for property damage caused by slight negligence; this does not apply to personal injury.

Skiing and cycling involve risks. Please ride within your ability and follow the FIS rules of conduct and traffic rules.

Right of withdrawal

For rental equipment booked online for a specific period, there is no statutory right of withdrawal under § 18(1)(10) of the Austrian Distance and Off-Premises Contracts Act (FAGG). Regardless of this, you can cancel free of charge under these terms.

Applicable law, jurisdiction and language

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of your country of residence remain unaffected. For claims against consumers, § 14 of the Austrian Consumer Protection Act (KSchG) applies.
